I think Gorcenski's analysis is flawed tbh; I think it undersells the risk that US democracy is under and ignores that right-wingers are coming up with more sophisticated methods of legislating to reach their end goals. It ignores that figures like DeSantis and Abbott have been very effectively exercising power in ways that there aren't really normal mechanisms for stopping, like Abbott tanking a major trans care program in Texas effectively by means of back room threats and pressure. The actual reality is that things are quite bad, and bad in ways that are resulting in things like political refugees.
The legal arena is incredibly important and effective, both in court and tangling with legislatures. We should also be pursuing and advocating other avenues as well. This is fundamentally an all hands on deck kind of scenario; some people are going to fight in court, some are going to fight in state houses, some are going to build mutual aid and community defense, and some are going to do things that range from kind of illegal to incredibly illegal. We want and need all of it.
